Article 1: General provisions
The seller's e-commerce webshop offers its customers the opportunity to purchase products from its online store online. These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce webshop ("Customer"). Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance in writing.
Article 2: Price
All prices stated are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation or administrative costs are charged, this will be stated separately (under the heading 'Delivery').
The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce webshop have been compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding. The seller is under no circumstances liable in the event of manifest material errors, typesetting or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.
The offer is valid while supplies last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.
Article 4: Online purchases
The Customer has the choice between bank transfer or credit card as payment methods.
The seller is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
Any visible damage and/or qualitative deficiency of an item or other deficiency in the delivery must be reported by the Customer without delay within a period of 14 days to the email address info@podamira.com. The order number, the damage that has occurred and an image of the damaged items must be stated.
The risk of loss or damage is transferred to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods.
Orders are always processed within 2 working days (working days are Monday - Friday) unless otherwise indicated in the shipping method or due to closure due to holidays or vacation period. Closure for vacation period is always clarified on the webshop. Orders are usually processed within a period of maximum 2 working days. Once your order is picked up by the carrier, you will always be kept informed of the location of your package by means of a track and trace code. The delivery time usually takes two to three working days. The total time of the shipping and delivery of your order is therefore five working days. In exceptional cases, the delivery of an order can take up to 20 working days. An exceptional situation may be that the products are not in stock. If this or another reason should occur that affects the delivery time, the customer will always be contacted.
It is possible to pick up packages at our office. The package will then be picked up at our office. No extra costs are charged for this.
Article 6: Retention of title
The delivered items remain the exclusive property of the seller until full payment has been made by the Customer.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online in their capacity as consumers.
The consumer has the right to revoke the agreement within a period of 14 calendar days after the day on which the product was received, without giving reasons, given that the right of withdrawal applies to the goods or services ordered by the customer. In order to exercise the right of withdrawal, the Customer must inform the seller in a timely manner of his decision to revoke the agreement by means of an unambiguous statement (e.g. in writing by post or e-mail). The product must be unopened, undamaged and in its original condition. For hygienic reasons, opened or used skincare products cannot be taken back. The return must be sent back within 14 days of your revocation notification.
Send the completed return form (found under the heading 'Return Policy') by email to info@podamira.com to register the return. The customer will then receive the instructions for returning the goods. The return costs are at the customer's expense, unless it is an error on our part (wrong or damaged product). The package must be returned properly packaged to the specified return address. Once the notification of withdrawal has been made to the company, the consumer has 14 days to return the goods.
Once we have received your return in good condition, we will refund the purchase price (including shipping costs) within 14 days.
PLEASE NOTE If the returned product has been diminished in value in any way, the right to hold the Customer liable and claim damages for any diminished value is retained.
In the event that the agreement includes the provision of services and if the Customer has requested that the provision of services begin during the withdrawal period, the Customer shall pay an amount that is proportional to what has already been delivered at the time that he has informed us that he is withdrawing from the agreement, compared to the full performance of the agreement."
Article 8: Warranty
Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. To invoke the warranty, the Customer must be able to provide proof of purchase.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
Article 9: Sanctions for non-payment
Without prejudice to the exercise of other rights, in the event of non-payment or late payment, the Customer is legally liable to pay interest on the unpaid amount from the date of the breach of contract and without notice. Without prejudice to the foregoing, the right is reserved to take back items that have not been (fully) paid for.
Article 10: Affect of validity - non-renunciation
If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by the seller to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights .
Article 11: Changes to conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to and the seller's general terms and conditions of sale. In the event of any contradiction, these Terms and Conditions shall prevail.
Article 12: Applicable law
Belgian law applies. The courts of the Seller's place of residence have jurisdiction in legal disputes. The Seller can also turn to the ODR platform.
